Terms of Service

1. Agreement
These Terms of Service ("Terms") form a binding agreement between you ("you," "Customer," or "User") and SerpentAPI ("SerpentAPI," "we," "us," or "our") governing access to and use of serpentapi.com, our dashboards, APIs, documentation, and related services (the "Services").
By creating an account, accessing the Services, or calling our APIs, you agree to these Terms and our Privacy Policy. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes that organization.
If you do not agree, do not use the Services.
2. The Services
SerpentAPI provides developer infrastructure to retrieve and structure publicly available search engine results pages (SERPs) and, where enabled, webpage content you request via our APIs. We act as a technical gateway and data-processing service. We do not operate Google, Bing, Yahoo, DuckDuckGo, Yandex, Baidu, Brave, Naver, or any other third-party search engine or website, and we do not control their content, rankings, availability, or terms.
Features, engines, rate limits, token pricing, and documentation may change. Status information on our status page is informational and is not a contractual SLA unless we expressly agree otherwise in a signed writing.
3. Eligibility and accounts
- You must be at least 18 years old (or the age of majority where you live) to use the Services.
- You must provide accurate registration information and keep it updated.
- You are responsible for all activity under your account, passwords, and API keys.
- You must keep credentials confidential and notify us promptly at support@serpentapi.com if you suspect unauthorized use.
- We may refuse, suspend, or terminate accounts that appear abusive, fraudulent, or non-compliant.
4. License and intellectual property
Subject to these Terms and your active paid plan (where required), we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business or personal development purposes.
SerpentAPI and its licensors own all rights in the Services, software, branding, documentation, and underlying technology. These Terms do not transfer ownership of any SerpentAPI intellectual property to you.
Third-party content returned by the Services (including search results, snippets, titles, links, and markup) remains the property of its respective owners. Delivery of that content through the Services does not grant you ownership of it, nor any trademark, copyright, or other rights beyond the limited ability to receive API responses under these Terms.
You retain rights in Customer Content you submit (queries, URLs, parameters). You grant us a worldwide, royalty-free license to host, process, transmit, and display Customer Content solely as needed to provide and secure the Services, enforce these Terms, and comply with law.
5. Customer compliance — critical
You are solely responsible for determining whether your use of the Services and of any data obtained through the Services is lawful in your jurisdiction and for your intended purpose. This includes compliance with:
- Applicable laws and regulations (privacy, consumer protection, computer fraud/abuse, export controls, intellectual property, and others)
- Third-party website and search engine terms of service, robots and access policies, and contractual restrictions that apply to you
- Laws governing collection, storage, use, sharing, and commercialization of personal data that may appear in search results
- Industry rules applicable to your product (advertising, finance, healthcare, employment screening, etc.)
We provide tools that retrieve publicly available information at your direction. We do not provide legal advice, and we do not warrant that any particular use case, query, retention practice, or downstream use of results is lawful. You should consult your own counsel before relying on the Services for regulated or high-risk activities.
6. Acceptable use
You agree not to misuse the Services. Prohibited activities include, without limitation:
- Using the Services for fraud, harassment, stalking, doxxing, extortion, or other harmful activity
- Violating others' privacy, publicity, or intellectual property rights
- Collecting, processing, or distributing data about children, or any content involving child sexual exploitation or abuse
- Building or operating malware, phishing, spam, credential stuffing, denial-of-service, or similar attacks
- Attempting to bypass authentication, rate limits, billing, or security controls
- Reverse engineering the Services except to the limited extent permitted by mandatory law
- Reselling, sublicensing, or providing the raw API as a competing hosted SERP service without our prior written consent
- Using SerpentAPI trademarks or implying endorsement by any search engine or third-party site
- Submitting unlawful content, or using results to violate export controls, sanctions, or prohibited-trade rules
- Interfering with other customers' use of the Services or with our infrastructure
We may investigate suspected violations and may throttle, suspend, or terminate access immediately, with or without notice, to protect the Services, other users, third parties, or ourselves, or to comply with law.
7. API keys, quotas, rollover, and fair use
- API access requires valid credentials. Keep keys secret; do not embed them in public client-side code or public repositories.
- Usage is metered in tokens or other units described in pricing/docs.
- You must comply with rate limits and fair-use constraints. We may throttle or reject traffic that threatens platform stability.
- You are responsible for all usage attributable to your keys, including usage by employees, contractors, and integrated systems.
Token rollover
At the end of each paid billing period, thirty percent (30%) of unused tokens from that period may roll into the immediately following billing period ("Rollover Tokens"). Rollover Tokens must be consumed during that following period; unused Rollover Tokens expire and do not roll again. When you use the Services, we consume Rollover Tokens before newly issued monthly allotment tokens. Your total available token balance in any period (Rollover Tokens plus the current monthly allotment) will not exceed one hundred thirty percent (130%) of your plan's standard monthly token allotment. Rollover does not change plan price, rate limits, or other plan features, and may be adjusted or discontinued prospectively with notice as described in these Terms.
8. Plans, billing, taxes, and refunds
- Paid plans are billed through Stripe (or another processor we designate) on a recurring basis unless canceled.
- Prices, included tokens, and features are described on the pricing page and may change prospectively.
- You authorize us (and our processor) to charge your payment method for subscription fees, applicable taxes, and any agreed overages.
- You are responsible for applicable taxes other than taxes based on our net income.
- Failure to pay may result in suspension or termination of access.
Cancel anytime via the billing portal or account tools we provide; cancellation typically takes effect at the end of the then-current billing period unless otherwise stated.
Refunds
If you request a refund during an active paid billing period, we may issue a prorated refund as follows: we value tokens already consumed in that period at your plan's standard rate (the plan's monthly price divided by its monthly token allotment), deduct that usage value from fees paid for the period, and refund the remaining unused balance to your original payment method. Refunds are typically processed within five to ten (5–10) business days. We may decline refunds in cases of abuse, chargebacks after a refund has been issued, or accounts terminated for violation of these Terms. Nothing in this section limits refund rights that cannot be waived under applicable law.
9. Third-party data and no affiliation
Search results are obtained from third parties and may be incomplete, inaccurate, outdated, offensive, or unlawful. We do not endorse, verify, or guarantee third-party content. Search engine and website names are trademarks of their owners; use of those names is solely descriptive of interoperability and does not imply affiliation, sponsorship, or endorsement.
Upstream providers may change, rate-limit, block, or restructure their services at any time. Temporary or permanent unavailability of a particular engine or site is not a breach by SerpentAPI.
10. Beta features and changes
We may offer beta or experimental features "as is." We may modify, deprecate, or discontinue any part of the Services. Where practical, we will provide reasonable notice of material breaking API changes via documentation, email, or the dashboard.
11. Confidentiality
Non-public information about the Services, pricing negotiations, security details, and unpublished documentation should be treated as confidential and not disclosed except to personnel who need it and are bound by confidentiality obligations, or as required by law.
12. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT RESULTS WILL BE ACCURATE, COMPLETE, OR LAWFUL FOR YOUR USE CASE. YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE SERVICES AND OF ANY DATA OBTAINED THROUGH THEM.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERPENTAPI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO SERPENTAPI FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM (OR ONE HUNDRED U.S. DOLLARS (US $100) IF YOU HAVE NOT PAID ANY FEES).
These limitations are a fundamental part of the bargain and apply regardless of the legal theory (contract, tort, strict liability, or otherwise), and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain exclusions; in those cases, our liability is limited to the fullest extent permitted.
14. Indemnification
You will defend, indemnify, and hold harmless SerpentAPI and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Services or of data obtained through the Services
- Customer Content you submit
- Your violation of these Terms or applicable law
- Your violation of third-party rights or third-party terms
- Any product, service, or dataset you build using API results
15. Suspension and termination
You may stop using the Services at any time and may cancel a paid subscription as described in Section 8. We may suspend or terminate access immediately if you breach these Terms, fail to pay, create risk or legal exposure for us or others, or if we discontinue the Services.
Upon termination, your license ends and you must stop using the Services. Sections that by their nature should survive (including intellectual property, compliance, disclaimers, limitations of liability, indemnification, and governing law) will survive termination.
16. Export and sanctions
You may not use the Services if you are located in, or are a resident or national of, a country or region subject to comprehensive U.S. or other applicable embargoes, or if you are on any restricted-party list. You represent that you are not prohibited from receiving the Services under applicable export and sanctions laws.
17. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Exclusive venue for disputes that are not subject to informal resolution will lie in the state or federal courts located in Delaware, and you consent to personal jurisdiction there, except where prohibited by mandatory consumer-protection law.
Before filing a claim, you agree to contact support@serpentapi.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
18. Changes to these Terms
We may update these Terms from time to time. We will post the revised Terms with an updated effective date. If a change is material, we may also provide notice by email or in-product message. Continued use after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Services and cancel any subscription.
19. Miscellaneous
- These Terms, together with the Privacy Policy and any order or plan details, are the entire agreement between you and SerpentAPI regarding the Services.
- If any provision is unenforceable, the remaining provisions remain in effect.
- Our failure to enforce a provision is not a waiver.
- You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- There are no third-party beneficiaries to these Terms except as expressly stated for indemnified parties.
